This book provides a practical introduction to the Government’s new Grey Belt policy, one of the most significant innovations in Green Belt policy in the past seven decades.
Part I begins by setting out the legal and policy framework, the key legislative provisions, the history of the policy and the current policy and guidance.
Part II then examines the core components of a Grey Belt case, including the Glossary definition, the NPPF 155 requirements and the Golden Rules. It also examines the use of Very Special Circumstances as a fallback position.
Part III builds on the above, to provide practical advice on both Applications and Appeal documents, specifically how to draft Planning Statements, Appeal Statements of Case and Proofs of Evidence, and relevant supporting documents.
Part IV then examines the role of Planning Court, including the role of judicial review and statutory review in exploring policy interpretation and related legal issues.
