Faculty Jurisdiction of the Church of England 2nd ed

ISBN13: 9780421439603
Published: June 1993
Publisher: Sweet & Maxwell Ltd

This is the second edition of the standard work on a specialist area of property law and practice. The book considers the work of the Consistory Court of the Church of England, which has jurisdiction over all church land, buildings and their contents. It is an authoritative and comprehensive guide to this very specialized area of property law. A major new measure dealing in particular with the Rules relating to listed buildings and with various matters of jurisdiction and procedure was passed in 1990 entitled the Care of Churches and Ecclesiastical Jurisdiction Measure 1991 by the General Synod, the governing body of the Church of England. The rules passed under it are the Faculty Jurisdiction Rules 1992 and the Faculty Jurisdiction (Injunction and Restoration Orders) Rules 1992. There are three appendices reproducing the most important Measures and Rules, that give precedent documents, and a discussion on the ecclesiastical exemption from listed building control and ancient monument legislation.
